Terms & Conditions

1. Operator

PHOTARCH is a service operated by Arkeologibyrån, a registered trade name (bifirma) under DLD Daniel Lindskog Design, org. nr 810717-4156, based in Ystad, Sweden. By using PHOTARCH you accept these terms.

2. Access and Accounts

Public browsing of the PHOTARCH archive requires no account. Creating an account gives access to additional features including higher-resolution downloads, saved collections, and TIFF exports, depending on your membership tier.

You are responsible for keeping your login credentials confidential. You must not share your account or use it in any way that exceeds the access level of your current membership.

3. Use of Images and Metadata

Images and metadata in the PHOTARCH archive are published under open access conditions. Unless otherwise stated on an individual object record, images may be used for research, education, and non-commercial purposes with appropriate attribution to PHOTARCH and the originating institution.

Commercial use of archive images requires written permission from PHOTARCH. Contact us at info@photarch.com before use.

Attribution format: Image: PHOTARCH / [Institution name], ARK:[identifier]

4. Commissions

Digitization commissions are subject to a separate commission agreement confirmed in writing between PHOTARCH and the commissioning institution. These terms do not supersede any specific provisions in that agreement.

Pricing, delivery scope, and timelines are set out in the commission request process. Commissioned work becomes part of the PHOTARCH archive unless otherwise agreed.

5. Memberships and Payments

Paid memberships are billed according to the selected plan. Payments are processed securely via Stripe. PHOTARCH does not store payment card details.

Memberships renew automatically unless cancelled before the renewal date. Refunds are not issued for partial periods, except where required by applicable law.

6. Prohibited Use

You may not use PHOTARCH to scrape, mirror, or bulk-download the archive by automated means without prior written agreement. You may not misrepresent the origin or conditions of images obtained from the archive.

7. Limitation of Liability

PHOTARCH is provided as-is. We make no warranties regarding the completeness or accuracy of metadata provided by third-party institutions. PHOTARCH is not liable for any loss arising from use of, or inability to access, the service.

8. Governing Law

These terms are governed by Swedish law. Disputes are subject to the jurisdiction of Swedish courts, with the District Court of Malmö (Malmö tingsrätt) as the court of first instance.

9. Changes

We may update these terms as the service develops. Continued use of PHOTARCH after a revision constitutes acceptance of the updated terms. Material changes will be announced on the platform.
